Morgan Blasts Gasparino Over Judge’s Ruling
Renowned crypto lawyer Bill Morgan has criticized FOX Business journalist Charles Gasparino for calling Judge Analisa Torres “doltish” regarding her ruling in the SEC Vs Ripple case. Morgan explained that the judge’s decision was rooted in the facts provided by the SEC, asserting that Gasparino misdirected his criticism.
> “You think Judge Torres is doltish because she decided that Ripple’s institutional sales directly to institutions are investment contracts and programmatic sales in the secondary market were not investment contracts despite the vastly different facts between the different sales…”

Morgan emphasized that the SEC made a formal distinction between Ripple’s sales to institutional investors and those in the secondary market, indicating that Judge Torres’ ruling stemmed from the SEC’s arguments and the Howey test, thus absolving her of Gasparino’s claims.

Gasparino has faced backlash from both the SEC and XRP proponents for his perspective on the ongoing litigation. He has criticized the SEC’s handling of the case, alleging that it has misplaced priorities and overreached in regulatory matters. He believes the SEC’s actions forced Ripple to relocate its promising technology, resulting in a loss for the U.S.
